1. Acceptance of These Terms

These Terms & Conditions (“Terms”) govern your access to and use of wendyunlocked.com (the “Site”). By accessing or using the Site, creating an account, or submitting a form, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site.

2. Who We Are

The Site is operated by Wendy Sanchez, a licensed Florida real estate professional (“we,” “us,” “our”). All real estate brokerage services referenced on the Site are offered through the licensed real estate brokerage with which Wendy Sanchez is affiliated.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site or create an account. By using the Site you represent that you meet these requirements.

4. No Professional Advice; No Brokerage Relationship

Content on the Site is general information about real estate markets and services. It is not legal, tax, financial, appraisal, engineering, or investment advice, and it is not a substitute for advice from a qualified professional retained by you.

Using the Site, submitting a form, or creating an account does not create a brokerage relationship. A brokerage relationship arises only through a separate written agreement that complies with Chapter 475, Florida Statutes, and the rules of the Florida Real Estate Commission.

5. Property and Market Information

Property descriptions, prices, availability, square footage, taxes, fees, images, and market statistics shown on or linked from the Site are provided for general reference. They may come from third parties, including multiple listing services and property owners, and may be incomplete, outdated, or inaccurate. All information is deemed reliable but is not guaranteed and should be independently verified. Nothing on the Site is an offer to sell or a solicitation of an offer to buy any property or security. Properties are subject to prior sale, lease, change, or withdrawal without notice.

Any statements about past performance, sales volume, awards, or market outcomes describe past results and are not a promise or prediction of future results.

6. Equal Housing Opportunity

We support and comply with the Fair Housing Act and all applicable federal, state, and local fair housing laws. All properties referenced on the Site are offered without regard to race, color, religion, sex, disability, familial status, national origin, or any other characteristic protected by law.

7. Member Accounts and Gated Content

Parts of the Site, including Exclusive Listings, require a free member account. You agree to provide accurate registration information, to keep your password confidential, and to be responsible for all activity under your account. Notify us promptly at wendy@thewendysanchez.com if you suspect unauthorized use.

Gated content is provided for your personal, non-commercial use. You may not scrape, republish, redistribute, or resell it, or share your credentials with others. We may suspend or terminate any account at any time, with or without notice, including for violation of these Terms. You may close your account at any time by contacting us.

8. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms;
  • Submit false, misleading, or impersonating information, or use another person’s contact details without authorization;
  • Scrape, crawl, harvest, or use automated means to access or copy Site content, except for search engine crawlers acting in accordance with our robots.txt;
  • Attempt to gain unauthorized access to the Site, accounts, or systems, or probe, scan, or test the vulnerability of any system;
  • Introduce malware, or interfere with or overload the Site’s operation;
  • Send spam, chain messages, or unsolicited commercial communications through Site forms;
  • Use the Site to compile a database of listings, contacts, or property data;
  • Remove, obscure, or alter any copyright, trademark, or other proprietary notice.

9. Text Messaging Terms

If you opt in to text messages, the following applies:

  • Program: real estate updates, listing information, appointment coordination, and replies to your inquiries, sent by Wendy Sanchez and her affiliated brokerage.
  • Consent: opt-in is voluntary and separate from any other agreement. Consent to receive marketing texts or autodialed or prerecorded calls is not a condition of purchasing any property, product, or service.
  • Frequency: message frequency varies and depends on your interaction with us.
  • Cost: message and data rates may apply. We do not charge for messages; your mobile carrier may.
  • Opt-out: reply STOP to any message. You will receive a single confirmation and no further messages.
  • Help: reply HELP, email wendy@thewendysanchez.com, or call (305) 619-2173.
  • Carriers: mobile carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and may be affected by your device, plan, or coverage.
  • Your number: you represent that the number you provide is yours and that you are authorized to receive messages at it. Notify us if the number changes or is reassigned.

We do not sell or share mobile opt-in data with third parties for marketing purposes. See our Privacy Policy.

10. User Content

“User Content” means anything you submit through the Site — messages, form entries, reviews, images, or other material. You retain ownership of your User Content. You grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute it solely to operate, promote, and improve the Site and our services.

You represent that you own or have the rights to submit your User Content, that it does not infringe any third party’s rights, and that it complies with applicable law. We may, but are not obliged to, review, edit, refuse, or remove any User Content at our sole discretion.

11. Intellectual Property

All Site content — text, graphics, logos, photographs, video, design, layout, and code — is owned by or licensed to us and protected by copyright, trademark, and other laws. You may view and print pages for your personal, non-commercial use. Any other reproduction, distribution, modification, framing, or commercial use requires our prior written permission.

Third-party names, logos, and marks appearing on the Site — including those of media outlets, associations, and multiple listing services — remain the property of their respective owners. Their appearance identifies the source of a referenced item and does not imply endorsement, sponsorship, or affiliation unless expressly stated.

12. Third-Party Sites and Services

The Site links to third-party websites and platforms, including Instagram, WhatsApp, Linktree, and external property search sites. We do not control them, do not endorse their content, and are not responsible for their availability, accuracy, or practices. Your use of them is governed by their own terms and privacy policies.

13. Copyright Complaints (DMCA)

If you believe material on the Site infringes your copyright, send a written notice to our designated agent, Wendy Sanchez, at wendy@thewendysanchez.com, including: your physical or electronic signature; identification of the work claimed to be infringed; identification of the material and its location on the Site; your contact information; a statement of good-faith belief that the use is unauthorized; and a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act for the owner. We may remove the material and, where appropriate, terminate repeat infringers.

14. Availability and Changes to the Site

We may modify, suspend, or discontinue the Site or any part of it at any time, with or without notice. We do not guarantee uninterrupted or error-free operation.

15. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE ACCURATE, COMPLETE, CURRENT, SECURE, OR FREE OF ERRORS, VIRUSES, OR INTERRUPTION. YOUR USE OF THE SITE IS AT YOUR OWN RISK.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER WENDY SANCHEZ, HER AFFILIATED BROKERAGE, NOR THEIR OWNERS, AGENTS, OR EMPLOYEES WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, WHETHER BASED IN CONTRACT, TORT, STATUTE, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). Nothing in these Terms limits liability that cannot be limited under applicable law, and this section does not apply to obligations arising under a separate signed brokerage or transaction agreement.

17. Indemnification

You agree to indemnify and hold harmless Wendy Sanchez, her affiliated brokerage, and their owners, agents, and employees from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your User Content, or your breach of these Terms or of applicable law.

18. Governing Law, Venue, and Dispute Resolution

These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules.

Before filing any claim, you agree to contact us at wendy@thewendysanchez.com and attempt to resolve the dispute informally for at least thirty (30) days.

If the dispute is not resolved, you and we agree that the exclusive venue for any action will be the state or federal courts located in Miami-Dade County, Florida, and each party consents to the personal jurisdiction of those courts and waives any objection based on inconvenient forum.

19. Termination

We may terminate or suspend your access to the Site or your account at any time, for any reason, without notice. Sections 5, 10, 11, and 15 through 20 survive termination.

20. General

If any provision of these Terms is held unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site.

We may revise these Terms at any time by posting an updated version and changing the “Last updated” date. Material changes will be announced on this page. Continued use of the Site after an update constitutes acceptance.
