Privacy Policy
1. Who We Are
This website, wendyunlocked.com (the “Site”), is operated by Wendy Sanchez, a licensed Florida real estate professional (“we,” “us,” “our”). Real estate brokerage services referenced on the Site are provided through the licensed brokerage with which Wendy Sanchez is affiliated.
- Email: wendy@thewendysanchez.com
- Phone: (305) 619-2173
2. Scope of This Policy
This Policy explains what personal information we collect through the Site, how we use and share it, and the choices available to you. It applies to the Site and to related email, text message, and telephone communications we send in response to it.
It does not apply to third-party websites we link to, or to information you provide directly to a brokerage, lender, title company, or multiple listing service outside of this Site. Those parties handle your information under their own policies.
3. Information We Collect
3.1 Information you give us
- Contact form submissions: name, email address, telephone number, your stated timeframe and interest (buying, selling, refinancing, or browsing), and any message you write.
- Member account registration: first name, email address, password, and telephone number if you choose to provide it. Passwords are stored in hashed form and are not visible to us.
- Consent records: where you check a consent box, we record the text you agreed to, the date and time, the page URL, your IP address, and your browser user agent, so we can demonstrate the consent you gave.
- Correspondence: the content of emails, text messages, WhatsApp messages, and voicemails you send us.
3.2 Information collected automatically
- Device and usage data: IP address, browser type and version, operating system, device type, referring URL, pages viewed, links clicked, and the dates and times of your visits.
- Cookies and similar technologies: see Section 7.
3.3 Information we do not intentionally collect
We do not ask for Social Security numbers, financial account numbers, government identification numbers, or health information through this Site. Please do not submit that information through our forms. If you do, we will delete it when we identify it.
4. How We Use Your Information
- To respond to your inquiry and provide real estate services you request;
- To contact you by email, telephone, or — where you have separately consented — text message;
- To create and administer your member account and provide access to gated listing content;
- To send market updates, listing alerts, and other marketing communications where permitted by law or with your consent, and always with a way to opt out;
- To operate, secure, debug, and improve the Site, and to measure how it is used;
- To detect and prevent spam, fraud, and abuse;
- To keep business records and to comply with legal, regulatory, and real estate licensing obligations, including recordkeeping requirements applicable to licensed real estate professionals in Florida;
- To establish, exercise, or defend legal claims.
5. Text Messages and Telephone Calls
We send text messages only to people who have separately opted in by checking the SMS consent box on one of our forms. SMS consent is optional, is never pre-checked, and is never required in order to submit a form or to receive any service.
- Program description: real estate updates, appointment coordination, listing information, and replies to your inquiries.
- Message frequency: varies; messages are sent on a conversational and as-needed basis.
- Cost: message and data rates may apply. We do not charge for messages; your mobile carrier may.
- Opting out: reply STOP to any message to stop receiving texts. You will receive one confirmation message and no further texts.
- Help: reply HELP to any message, or contact us at wendy@thewendysanchez.com or (305) 619-2173.
- Carriers: mobile carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed.
No mobile information will be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except with subcontracted service providers who help us operate the messaging program and who are contractually prohibited from using that data for their own purposes.
Withdrawing SMS consent does not withdraw your consent to be contacted by email or telephone, and does not by itself close your member account. To stop all marketing contact, email us at wendy@thewendysanchez.com.
6. WhatsApp
The Site links to WhatsApp so you can start a conversation with us. If you use that link, your message and phone number are processed by WhatsApp under its own terms and privacy policy, which we do not control. We receive and retain the messages you send us there.
7. Cookies, Analytics, and Advertising
We and our service providers use cookies, pixels, and similar technologies to operate the Site, remember your login session, understand traffic, and measure the performance of our marketing.
- Strictly necessary: session, login, and security cookies set by WordPress. The Site cannot function properly without these.
- Analytics: a third-party web analytics service, which collects the usage data described in Section 3.2 and assigns a pseudonymous identifier to your browser so we can understand how the Site is used.
- Advertising: where enabled, a third-party advertising pixel used to measure the performance of our advertising and to show our ads to you on other platforms.
You can block or delete cookies through your browser settings; parts of the Site, including the member area, may then stop working. You can opt out of Google Analytics using Google’s browser add-on, and you can manage interest-based advertising through the tools offered by the Network Advertising Initiative and the Digital Advertising Alliance, and through the ad settings of the relevant platform.
Do Not Track. Browsers may send a “Do Not Track” signal. There is no common industry standard for responding to it, and the Site does not currently respond to it. We do honor recognized opt-out preference signals such as Global Privacy Control where required by applicable law.
8. How We Share Information
We share personal information only as described here:
- Service providers who act on our instructions — website hosting, email delivery, SMS delivery, CRM, analytics, and spam prevention — and who are permitted to use the information only to provide services to us;
- The licensed brokerage with which Wendy Sanchez is affiliated, and licensed team members working on your matter;
- Transaction participants you ask us to involve — for example a lender, title company, inspector, or cooperating broker — and only for the transaction you are pursuing;
- Legal and safety: where required by law, subpoena, or regulator, or where necessary to protect our rights, property, or the safety of any person;
- Business transfer: in connection with a merger, acquisition, or sale of assets, subject to this Policy;
- With your direction or consent in any other case.
We do not share your information with unaffiliated third parties for those parties’ own marketing purposes.
9. “Sale” and “Sharing” of Personal Information
We do not sell your personal information for money.
Some privacy laws define “sale” and “sharing” broadly enough to include the use of advertising and analytics cookies that transfer identifiers to third-party platforms for cross-context behavioral advertising. To the extent any such technology is active on the Site, that activity may qualify. You can opt out at any time by emailing wendy@thewendysanchez.com with the subject line “Do Not Sell or Share,” or by enabling Global Privacy Control in your browser.
We do not knowingly sell or share the personal information of anyone under 16 years of age.
10. Your Rights and Choices
Depending on where you live, you may have the right to:
- Know what personal information we hold about you and how we use and disclose it;
- Access a copy of that information, or receive it in a portable format;
- Correct inaccurate information;
- Delete your information, subject to legal and recordkeeping exceptions;
- Opt out of targeted advertising, the sale or sharing of your information, and profiling with legal effects;
- Not be discriminated against for exercising any of these rights.
State privacy statutes such as the Florida Digital Bill of Rights and the California Consumer Privacy Act apply only to businesses that meet specific size and revenue thresholds, and we may not meet those thresholds. Even where a statute does not require it, we will honor verifiable requests of the kinds listed above.
How to make a request. Email wendy@thewendysanchez.com. To protect your information we will ask you to verify your identity, usually by confirming details we already hold. We respond within 45 days and may extend once where permitted, telling you why. An authorized agent may submit a request on your behalf with written authorization, and we may still contact you to confirm it.
Marketing opt-out. Use the unsubscribe link in any marketing email, reply STOP to any text message, or email us. We may still send you transactional messages about a matter you are actively working on with us.
11. Data Retention
We keep personal information only as long as needed for the purposes described in this Policy. In practice: inquiry records are kept while we are in contact with you and for a reasonable period afterward; member accounts are kept until you ask us to close them; consent and opt-out records are kept for as long as needed to demonstrate compliance; and transaction-related records are kept for the period required by Florida real estate licensing law and applicable tax and recordkeeping rules. When a retention period ends, we delete or de-identify the information.
12. Security
We use technical, administrative, and physical safeguards appropriate to the size of our practice, including encryption of the Site in transit (HTTPS), access controls, and hashed password storage. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please do not send sensitive financial information by email or through Site forms.
13. Children’s Privacy
The Site is intended for adults and is not directed to children. We do not knowingly collect personal information from anyone under 13. If you believe a child has provided us information, contact wendy@thewendysanchez.com and we will delete it.
14. Third-Party Links
The Site links to third-party websites and platforms, including Instagram, WhatsApp, Linktree, and property search sites. We do not control those services and are not responsible for their content or privacy practices. Review their policies before providing information.
15. Fair Housing
We are committed to the letter and spirit of United States policy for the achievement of equal housing opportunity. We do not use personal information to discriminate on the basis of race, color, religion, sex, disability, familial status, national origin, or any other characteristic protected by federal, state, or local law.
16. Users Outside the United States
The Site is operated in the United States and intended for United States residents. If you access it from elsewhere, your information will be transferred to and processed in the United States, where privacy laws may differ from those in your country.
17. Changes to This Policy
We may update this Policy. When we do, we will revise the “Last updated” date above and post the new version on this page. If the changes are material, we will provide a more prominent notice. Your continued use of the Site after an update means you accept the revised Policy.
